Please check each item certifying you have read and agree to the terms of the LHS Adoption Contract/Waiver and confirm that all of the following statements are true:

Section 1(Required)

I agree to care for animal described above for its entire lifetime and am willingly adopting animal. Should I be unable to provide care of the animal, adopter will not give or relinquish it to any person, family member, group or shelter nor will they euthanize the animal. ANY ANIMAL ADOPTED FROM LHS IS REQUIRED TO BE RETURNED TO LHS SHOULD ADOPTER NO LONGER BE ABLE TO CARE FOR THE ANIMAL AT ANYTIME.

Section 1a(Required)

I will inform LHS of my inability to keep adopted animal. I agree to keep the adopted animal for a maximum of 14 days while allowing LHS time to find placement for the animal. Should I need to remove the pet from my home prior to the 14 days, I understand I have the option to board the animal at my expense.

Section 1b(Required)

I agree to provide LHS with proof of current vaccinations, heartworm test, proof of current heartworm preventative at the time I inform LHS of my inability to keep an adopted animal.

Section 2(Required)

I have the means to contribute an adoption donation in recognition of the care Legacy Humane Society, also known as "LHS" has provided for the animal. If an adopted animal is returned to LHS within 5 days of date contract/waiver is signed adopter may receive a full refund of the donation. Adopted animal must be returned to LHS in the same condition as the animal was when turned over to the adopter prior to the end of the 5th day to receive. Donation will be non-refundable at the end of the 5th day after the contract/waiver is signed.

I understand if I lose an adopted animal prior to the end of the 5th day after date contract/waiver is signed the adoption donation will not be refunded.

Section 4(Required)

I certify I have a secure fenced yard. If adopter does not have fenced yard they agree to exercise animal daily and work diligently to implement all necessary training, including but not limited to potty training

Section 5(Required)

I agree to abide by state, city and county ordinances regarding animal, including licensing the animal with the city it will be residing in and animal will be provided with an ID tag within 24 hours of taking the animal home

Section 6(Required)

I certify this animal is being adopted as my own companion animal, and will not be given as a gift, resold, or used as a guard dog

Section 7(Required)

I SWEAR I HAVE NOT PREVIOUSLY SURRENDERED A PERSONAL PET TO A SHELTER

Section 8(Required)

I certify all animals currently in my home have been spayed/neutered and are kept indoors

Section 9(Required)

I agree to always provide proper and necessary care for the animal adopted, including but not limited to humane treatment, shelter, food, love and veterinary care including monthly heartworm preventative, and vaccinations for the lifetime of the animal

Section 10(Required)

I understand that LHS does not guarantee the breed. weight. age. health and/or current or future temperament of the animal I am adopting and disclaims any oral promises, warranties or agreements.

Section 11(Required)

I understand that animals can be unpredictable and LHS cannot anticipate or insure against unexpected conduct of animals adopted from LHS. Adopter/s acknowledge that LHS has not made through its agents, volunteers, or employees any warranties regarding the future condition, temperament, or conduct of the animal. Adopter hereby accepts the animal as is, assumes all risks and responsibilities associated with ownership of the animal. including bites, and Adopter hereby fully and completely releases, indemnifies and holds harmless LHS, its directors, officers, volunteers, agents, servants. and employees from any claim, cause of action or liability of any sort or nature, whether known or unknown, directly arising out of or in connection with the adoption, care, or ownership, maintenance, retention, temperament, conduct or condition of the animal.

Section 12(Required)

I swear no cosmetic surgery will ever be performed on the adopted animal for any reason, including but not limited to: cropping an animals ears, tail docking and debarking.

Section 13(Required)

I agree to and understand I may receive by email or other means; medical documentation, medical journals, spay/neuter appointment date and location and/or vaccination schedule from LHS for which I must adhere to required date and location as listed in documentation.

Section 14(Required)

I SWEAR TO AND UNDERSTAND I MUST HAVE AN UNALTERED ADOPTED ANIMAL SPAYED/NEUTERED ON THE DATE SET BY LHS AT THE LHS AUTHORIZED VETERINARIAN AS DESCRIBED ON MEDICAL JOURNAL. Sterilization can be performed once male and female animals are 4 months old. Sterilization can only be rescheduled for medical emergencies after confirmation of emergency by a designated LHS veterinarian. Sterilization of the animal is required under Chapter 828, Health and Safety Code. A violation of this chapter is a criminal offense punishable as a Class C misdemeanor.

Section 15(Required)

I understand that if adopted animal is under 12 months old and has not received 3 sets of vaccinations as required by LHS, I agree to have animal vaccinated within 3 days of date required in medical journal received from LHS. I understand I MUST email contact@legacyhumanesociety.org to schedule the vaccinations.

Section 16(Required)

I agree to and understand if animal has health issues requiring medical treatment that occur before the end of the 5th day contract/waiver is signed and dated I must contact an LHS representative to schedule treatment at an LHS approved veterinary clinic. LHS will be not responsible for any costs related to medical treatment without prior written authorization from an LHS representative during the 5 days.

Section 17(Required)

Adopter warrants that he/she is: IS 21 YEARS OF AGE OR OLDER; RESIDES IN HIS/HER OWN HOME OR IN A PET FRIENDLY APARTMENT COMPLEX AND HAS PROVIDED PROOF OF PAID PET DEPOSIT TO LHS; IS THE HEAD OF THE HOUSEHOLD; HAS CONSIDERED HIS/HER LIFESTYLE AND HAS THE TIME, PATIENCE AND IS FINANCIALLY RESPONSIBLE ENOUGH TO CARE FOR THIS ANIMAL FOR THE LIFETIME OF THE ANIMAL HAS INFORMED LHS OF ALL MEMBERS OF THE HOUSEHOLD, INCLUDING SMALL CHILDREN AND ANIMALS; THAT ALL MEMBERS OF THE HOUSEHOLD HAVE AGREED UPON THE SELECTION OF THE PET AND WELCOME THEM INTO HIS/HER HOME.

ENFORCEMENT OF CONTRACT: This contract/waiver is binding and enforceable by law. Failure to adhere to the contract/waiver in part or whole may result in removal of adopted animal from adopters home, with no credit or refunds to adopter. In addition, without LHS waiving any of our rights under the contract/waiver, LHS will be owed a termination penalty from adopter in the amount of $1,000 and reasonable liquidated damages to compensate for costs and expenses in connection with adopter's breach of any terms in agreement.

I have read, understand and agree to all of the acknowledgements & releases listed above. I certify that the information provided on this form is true and correct to the best of my knowledge. BY SIGNING THIS CONTRACT/WAIVER, I AGREE TO ABIDE BY ANY AND ALL TERMS SET FORTH ABOVE.
